DGAD publishes the notification for initiation of the investigation, without any mention about the data taken into account. The notification is opaque and only states that the authority has come to a prima facie conclusion of the existence of the need for imposing ADD. The notification informs the parties to take inspection of documents. Why cant the documents be made available at the site in pdf format on day one. After all only the non confidential documents are given to the interested parties and making them available at the website on day one is not going to harm any one adversely and will only help in cutting the unnecessary correspondence and waste of time. The notification gives 40 days time to respond. If DGAD delays the supply of documents, which is natural for a Govt dept in India, even 40 days will be a short period. Again another typical mindset in the babus is that the more important a matter is, the more number of days should be spent on it. This is the requirement to underscore the importance of the issue. Another factor which acts as a stumbling block is the inherently insensitive nature of the babus when it comes to the principles of natural justice. Their stiff upper lip actions lead to many of their proceedings being quashed by the judiciary for the failure to follow the principles of natural justice.
